Jason West and Vince Zampella have made moves to counter Activision's recent attempt to include Electronic Arts into their legal clash, stating the extension necessary would cause undue financial hardship.The former Infinity Ward heads allege that Activision knew of the apparent involvement of EA as early as six months ago, and has waited until now to launch a suit amendment to hit the pair where it hurts. If accepted, Activision's amendment would mean the trial - scheduled for May - will be pushed back.
"Any delay of the trial in this lawsuit would increase the financial and non-financial burdens and would continue to distract us from running our business and earning a living," reads the statement, indicating that the costs of the mega-trial is taking its toll on the developers.
Indeed, the legal document notes that West and Zampella "are paying for this litigation from our own funds" and that costs to date have already exceeded the pair's combined annual salaries.
