Plaintiffs Hit Back in Xbox 360 Scratch Case
Recently Microsoft responded to a class action suit being brought against it in the USA, stating that only 55,000 Xbox 360s have been reported as scratching CDs. The company stated that this figure was less than one half of 1% of the install base.

Now one of the lawyers representing the plaintiffs in the case has responded. Keller Rohrback L.L.P. has issued a statement in the case currently before Hon. John C. Coughenour of the United States District Court, Western District of Washington. In the statement, the lawyers claim that, "Microsoft fails to address Plaintiffs' allegations that both the Sony PlayStation 3 and Nintendo Wii are far less prone to disc scratching because of their slower speeds of game disc rotation and their more robust and effective disc retention designs."

The lawyers further claim that, "Microsoft should have anticipated this design defect and resolved it before bringing the product to market. Microsoft also should have taken reasonable steps to remedy the defect after its discovery beyond placing a temporary warning sticker on the disc tray and burying a statement in the user manual, because even small unintentional movements of the Xbox 360 may scratch discs and render them permanently unplayable. "

Mst scratching i have seen is from tards moving the console while a disk is still in the drive and spinning I repair at least 5 a day from this.

But the bigger issue imo is the disk cracking as the disks on the 360 are such poor quality!

I love the quality of a Blu-Ray you can really feel the diffrence between the two.

Its too easy to completely ruin a disc. It shouldn't be that easy, and the discs shouldn't be damaged as badly as they are.

The one time this was an issue for me, I was reaching behind my 360 to reattach a Cat 5 cable which had become disconnected (the little latchy thing was broken) I barely lifted the rear corner while feeling around with my hands for the port and was rewarded with the most violent noises coming from the drive. Thank goodness it was a rental, and the place I rent from has a 5-figure (they said it was over $10K) disc resurfacing machine, so I ended up OK.

Replacement discs should be available at reasonable cost, regardless. Certainly less than $15. There is no justification for charging more than cost, those requesting replacement discs are loyal customers, charging more is disingenuous and counterproductive, in my view, for many reasons.

If treated with a common sense level of care the discs won't scratch. Why would someone move the unit around while it was running? I would side with Microsoft as they list warnings and instructions as to proper console use. Some people always want to blame others for their screwups. I have over sixty games and none are scratched whatsoever. None have shattered, which I laughed at when I read that comment.

My Xbox died when i put a disk with bubbles in it . It was a bad disk ( I think it was SAM FISHER on my 1st XBOX Org . ) , sounds like Woodstock ! PLZ be careful we have some bad disks floating around !!! ALITTLE STAT 4 YOU ALL ; 500,000 DEAD XBOXS IN THE WORLD ! I KNOW THIS BECAUSE IM ON MY 7TH ! 14 CONTROLLERS , 5 HEAD SETS , 3 WIRELESS HEAD SETS , AND IM THINKIN WHY ALWAYS JUST AFTER THE WARRENTY EXPIRES ???

i got my xbox a week before xmas and all of a sudden today my disc are starting to have scratches in ring shape on them

But we're living in a post-CD-Walkman world, people are used to CD/DVD players you can move and cary around. They don't expect to have to bolt a CD/DVD player down before inserting a disc. Sometimes, you just have to shift the unit a little - to get to things, or plug in a lead...

I mean, it's fine that this problem existed. I'm not suggesting that Microsoft should have designed the 360 to be portable. But once the problem was spotted, why didn't Microsoft fix it?
