The Japanese high court has chosen to lift the ban on second hand games sales in Japan. In two separate cases, judges found in favour of the play-trade shop chain ACT.

The company was taken to court by, amongst others, Sony, Capcom and Konami, who complained that the commercial trade in second hand games was massively damaging to the industry.

The main gist of the Software companies’ complaint is that the sale of a second hand game equates to a sales-to-player ratio of more than 1:1. They argued that this, in effect, was no different to the second owner of the game buying a pirate version.

This argument was thrown out of court, meaning that the frenetic, organic gaming frenzy that is Akihabara can continue to trade in interesting, rare and obsolete games. The news has been warmly welcomed by Japanese gamers and across the world.
