We knew the legal tussle between Activision and former Infinity Ward bosses Jason West and Vince Zampella was going to get ugly, but today we get an idea of how just how ugly - with the pre-production hold up of Modern Warfare 3 as collateral damage.Activision is arguing, through fresh court documents released today (via
Kotaku), that West and Zampella's legal actions are "delaying pre-production of
Modern Warfare 3" - this is being used to strong-arm the company into an agreement as "leverage."
In the original filing, the two estranged studio heads demanded to be paid "substantial royalties" that were owed to them, and to regain the contractual rights to the
Modern Warfare name. The fact that Activision is already working on a third title shows that the publisher doesn't agree that they should own the brand.
In addition to the delay complaint, Activision also stated that "as a direct and proximate result of this breach of the covenant of good faith and fair dealing, Activision has been forced to commit additional resources to
Modern Warfare 3."
