Nintendo has successfully defended its Wii Remote technology patents against hardware company Motiva for a second time.

The Japanese manufacturer had already beaten Motiva in 2011 following claims of patent infringement, but this naturally led to an appeal by the claimant. A three-judge panel reconsidered the verdict and ruled in favour of Nintendo once again.

Not only did the panel decide that Nintendo did not infringe on existing patents, but it suggested that Motiva had no intention of creating products with its owned technology and was instead interested in a settlement. It was noted that Motiva did not take into account the financial investment spent by Nintendo to turn its patents into a marketable product.

"There is simply no reasonable likelihood that, after successful litigation against Nintendo, Motiva’s patented technology would have been licensed by partners who would have incorporated it," concluded Judge Sharon Prost.
