Following a tirade at the prosecution from the judge overseeing the matter of the US government versus Xbox 360 modder Matthew Crippen in the States, prosecutors have dropped the case.Wired reports that humbled prosecutor Allen Chiu telling U.S. District Judge Philip Gutierrez, "The government has decided to dismiss the indictment", putting an end to the potentially ground-breaking trial.
The case against modder, Crippem had been brought in order to test the anti-circumvention provisions of the 1998 Digital Millennium Copyright Act. The part of the bill relating to video gaming consoles makes it a crime "to offer a product or service that circumvents a technological measure designed to protect copyright material."
Crippen was facing two five year counts, who is now going back to school.
