Remember when No Doubt filed suit against the Activision for the misuse of its likeness in Band Hero? A Superior Court Judge has ruled in favour of the rock group in the latest round of courtroom faceoffs.Activision's defence was originally to invoke the freedom of speech protections under the 1st Amendment of the US Constitution. In addition to this, the publisher attempted to shift the case to a federal court as a copyright issue, rather than the right-of-publicity issue that No Doubt was claiming.
Los Angeles County Superior Court Judge Kenji Machida rejected both of these, leaving the band with a strong case to continue its lawsuit.
Naturally, Activision has told the
LA Times that it intends to appeal Judge Machida's ruling. It seems that the company can't get away from a legal battle these days.
