Bethesda Taking Legal Action on Fallout
Bethesda is to sue Interplay and has kicked off proceedings by requesting an injunction to stop the manufacture, sale, and distribution of Fallout Trilogy, (Fallout, Fallout 2 and Fallout Tactics).

This follows the disagreement we reported in April in which, "in which Bethesda stated its intention to "terminate the trademark license agreement between Bethesda and Interplay which was entered into April 4, 2007 for the development of FALLOUT MMOG."

This time around, according to a complaint filed with District Court of Maryland on September 9 and obtained by Gamasutra, this intention is now in action.

Geeze, just put the boot in, why don't you? Seriously, Interplay developed and published all three of those games, they were the creator and owner of the trademark at that time; surely they retain the right to use it in respect of those items no matter the subsequent sale of that trademark to Bethesda?
