It's one thing for Apple's iPhone and iPod Touch to be on fire when it comes to games development at the moment - it's quite another for a piece of Apple hardware to actually explode. This is apparently the case with the iPod belonging to Liverpudlian 11 year-old, Ellie Stanborough.

Her dad, Ken, tells The Times,"It made a hissing noise. I could feel it getting hotter in my hand, and I thought I could see vapour. He lobbed the device out of the door and, "within 30 seconds there was a pop, a big puff of smoke and it went 10ft in the air".

So far so bad. However, Apple is being accused of throwing petrol on the flames by apparently offering the Stanboroughs compensation but only if they signed a letter that wanted them to "agree that you will keep the terms and existence of this settlement agreement completely confidential." In the event that they did, for example take the money and then go and talk to a newspaper, Apple would seek "injunctive relief, damages and legal costs against the defaulting persons or parties".

They didn't take the compensation. Has anybody had the same kind of deal with any of the platform holders over, let's say 'faulty' consoles? Tell us in confidentiality at feedback@spong.com

Spolsion Pod, that should be a new game, lol.

If I were them, I'd skip on Apple's covering their asses hush compo (I'd hear them out ofcourse, first). The average newspaper story will pay better at least, and this could really hurt Apple. Should be interesting to see if others have problems with theirs

Hmm, they didn't take the compensation... presumably because they hoped they could make more money squealing to the papers.

Yeah. This smells like it has "make a fast buck" sprayed all over it. iPods are not hand grenades, even if they were to somehow overheat.

Standard legal stuff (nonsense) but if you want more than a little compensation (like replacement of hardware/software and a little extra for the inconvenience), what do you expect.

There should be laws limiting some of this stuff, really. It is also a common way, used to cover up less than legal activities to. Laws against it's use to cover up illegal activities, or hinder investigation or legal proceedings (due process), and to ensure compensation is adequate otherwise and does not limit them in revealing.or affirming facts already revealed (so they can cash in if it already comes out). Things already done in good contracts.
